Wrong Is Still Wrong & Right Is Still Right



          As I find us still battling Oakley's Shop in Benson Arizona in an attempt to get our fully paid for car out of the shop I decided to put everything down under the chain of events.  By date.   This makes it easier to read   and will help when we do go to court.   You can also read my past posting about all of this and decide for yourselves if we have been done wrong.    As before we are looking for others with similar experiences from this shop so we can compare notes and hopefully get you to also take the shop to court.  

  

   July 29th (Sunday)     We towed car to Oakley's Garage.

   July 30th (Monday)   First shop contact --over the phone.

   July 31st (Tuesday)    First repairs to be finished---I walked miles to shop---car not finished.
        New repair thoughts  Shop 98% sure would fix  But almost $1000 parts and labor quoted over phone.  

  August 4th      Rented rental car from Enterpise

  August 6th  (Monday)  Told our car engine shot.   And our 2006 Hyundai Tucson not fixable.

  August 7th   Talked to financial  because we still owe on the now non working car.

  August 9th  Talked to our original car dealership

  August 10th    Talked to financial again.  
   
    Told shop worker we were calling our insurance company.

  August 12th   Attempted to make auto claim on our car.   Claim adjuster scheduled to come out.  If would take the claim--shop and financing would have been paid.

  Car moved by shop to an location not known by us. 

  Shop owner  (Doug) called me   informed me I needed to pay car in full for labor or he would file for an abandoned title on our car.  I could not pay with my Visa card over the phone.  And had a half hour before he was going home that day to get down there.  Our insurance agent called the shop, stating what day the claims adjuster would arrive. 

  August 16th    Claims adjuster comes to shop ---is sent to a side lot across town. 

  August 18th     Our insurance claim was not accepted.
         Called financial---shop had not released car to be repod

  August 23rd    My wife /part car owner (April) went into the hospital were she could not help   
   with car issues or make decisions.  

   August 25th   Bought new car

   August 26th   My wife (April) released from hospital
         Rental car returned to Enterprise

   August 29th  (Wed)  Our car paid in full   Labor for non fixed car and $60 towing to a location we still do not know.     $353. and some change     Received Visa credit card receipt only
    Owner (Doug)  said he would call our financial to release our car
    No other cash disccused
   No new RO shown or signed. 

   August 31st    Went into shop for detailed receipt    Told to come back Monday and talk to owner or cops would be called on me.   

    Sept 3rd   (Monday)   Called shop--Financing was never called.   
                     Asked for itemized receipt
                      Assured would receive on Tuesday when the shop owner would be in.  
                       He (Doug) had just had shoulder surgery.  

   Sept 4th    Went into shop    No owner in.   Reminded he had just had surgery.
    Gave shop worker list of items needed---   An itemized receipt, the car plates, cars location, 
    our car keys, the vehicle.  

   Sept 6th     Called shop---they had none of the items listed above
                       Was told would have to talk to shop owner.
                        First call to Benson Police department as a stolen vehicle
                         File insurance claim as a stole vehicle

     Random calls and visits to shop by my wife and I.   Each recorded.  

   Sept 10th (Monday)  Shop owner in! 
                 Police stand by
       I was asked to leave the shop until police arrived.
       New payment receipt issued  - repairs listed they had not done, 
        No tow charge on new receipt,  Date on top from when car was brought in (July 30th) not when bill paid in full
        No new RO issued or signed
        Shop claimed we owed $80 for towing and storage.  
        Police told us was a civil matter---no police report
        Our tape  recording states towing fees were paid in full --stated by shop worker

   Sept 11th    Financial still does not have OK for car to be released from shop
           Shop claims we still owe towing and would not release car
         Picket signs made by us
         We contacted court, BBB, AAA, and the Arizona Attorney General
          Asked by shop to prove car title was in our name.  

   Sept 15th     Asked owner  (Doug)    If the $80 was worth going viral online.   Was told 
        this was never about the cash.   He was holding my car because of my big mouth.

  Sept 25th  Claim we filed claim on payment for services rendered started on Visa card through Bank Of America


    I hope this clears things up for all.   My first posting describing it all got over 200 views!  Just from this blog page.   And it was up many other places for sure!    So please share this.
