Wrong Is Still Wrong & Right Is Still Right
As I find us still battling Oakley's Shop in Benson Arizona in an attempt to get our fully paid for car out of the shop I decided to put everything down under the chain of events. By date. This makes it easier to read and will help when we do go to court. You can also read my past posting about all of this and decide for yourselves if we have been done wrong. As before we are looking for others with similar experiences from this shop so we can compare notes and hopefully get you to also take the shop to court.
July 29th (Sunday) We towed car to Oakley's Garage.
July 30th (Monday) First shop contact --over the phone.
July 31st (Tuesday) First repairs to be finished---I walked miles to shop---car not finished.
New repair thoughts Shop 98% sure would fix But almost $1000 parts and labor quoted over phone.
August 4th Rented rental car from Enterpise
August 6th (Monday) Told our car engine shot. And our 2006 Hyundai Tucson not fixable.
August 7th Talked to financial because we still owe on the now non working car.
August 9th Talked to our original car dealership
August 10th Talked to financial again.
Told shop worker we were calling our insurance company.
August 12th Attempted to make auto claim on our car. Claim adjuster scheduled to come out. If would take the claim--shop and financing would have been paid.
Car moved by shop to an location not known by us.
Shop owner (Doug) called me informed me I needed to pay car in full for labor or he would file for an abandoned title on our car. I could not pay with my Visa card over the phone. And had a half hour before he was going home that day to get down there. Our insurance agent called the shop, stating what day the claims adjuster would arrive.
August 16th Claims adjuster comes to shop ---is sent to a side lot across town.
August 18th Our insurance claim was not accepted.
Called financial---shop had not released car to be repod
August 23rd My wife /part car owner (April) went into the hospital were she could not help
with car issues or make decisions.
August 25th Bought new car
August 26th My wife (April) released from hospital
Rental car returned to Enterprise
August 29th (Wed) Our car paid in full Labor for non fixed car and $60 towing to a location we still do not know. $353. and some change Received Visa credit card receipt only
Owner (Doug) said he would call our financial to release our car
No other cash disccused
No new RO shown or signed.
August 31st Went into shop for detailed receipt Told to come back Monday and talk to owner or cops would be called on me.
Sept 3rd (Monday) Called shop--Financing was never called.
Asked for itemized receipt
Assured would receive on Tuesday when the shop owner would be in.
He (Doug) had just had shoulder surgery.
Sept 4th Went into shop No owner in. Reminded he had just had surgery.
Gave shop worker list of items needed--- An itemized receipt, the car plates, cars location,
our car keys, the vehicle.
Sept 6th Called shop---they had none of the items listed above
Was told would have to talk to shop owner.
First call to Benson Police department as a stolen vehicle
File insurance claim as a stole vehicle
Random calls and visits to shop by my wife and I. Each recorded.
Sept 10th (Monday) Shop owner in!
Police stand by
I was asked to leave the shop until police arrived.
New payment receipt issued - repairs listed they had not done,
No tow charge on new receipt, Date on top from when car was brought in (July 30th) not when bill paid in full
No new RO issued or signed
Shop claimed we owed $80 for towing and storage.
Police told us was a civil matter---no police report
Our tape recording states towing fees were paid in full --stated by shop worker
Sept 11th Financial still does not have OK for car to be released from shop
Shop claims we still owe towing and would not release car
Picket signs made by us
We contacted court, BBB, AAA, and the Arizona Attorney General
Asked by shop to prove car title was in our name.
Sept 15th Asked owner (Doug) If the $80 was worth going viral online. Was told
this was never about the cash. He was holding my car because of my big mouth.
Sept 25th Claim we filed claim on payment for services rendered started on Visa card through Bank Of America

Had time for a little bit of Exploring last week.
Easily my favorite personal picture from the walk about.
Cheers to all this fine morning! And since you can not actually see me before I am called a lush for drinking so early and alone-- I am holding up my coffee mug proudly! Although after the last week a beer or three sounds great! Thus is my life though. ;) When I was still at my job six daze a week there were many times that I fully believe I ran only on caffeine and hate. A great combo if you ask me. But with all that hate, no one was asking me anything. I would like to say that things are getting better and slowing down---but I am still fighting battles that should have been put out weeks ago. In fact my last blog post here was all about most of that. And I have my coffee maker at my new place now. So things are looking up. I have so many things I should be doing right now I am going to make this a quick post and hopefully an entertaining one at that!

Publicity is Publicity ---right?
So as promised this is the entire story about our downed car. So that you can decide if my signs are warranted. Time and court will decide the rest my friends. In July our family vehicle, a 2006 Hyndi Tucson stopped running. My wife drove from ST David to Benson to pick me up from work, came inside for ten minutes and when we got back in the vehicle it would not start for anything. Because there were no warning signs, noises, or lights we were still under the impression it was going to be an easy fix. Because we still owed $2200 on the car, we went to a dealer a year in a half ago for a dependable car because we have three kiddos and are always on the road and at that time I worked in Tucson six days a week. We also had $400 a month car payments, so let friends look at our vehicle to save repair bills. No one could fix it after a month, so I went with the recommendation of a buddy and took the car to Oakley's Garage here in Benson. We towed the car to the garage. At that time I was told if they could not fix it, they would tow it to our house for free. At that time I was told a lot of things. We were new customers!
They had the car about a week before deciding it was a blown engine and not worth fixing. The shop did me a solid and sent back all the parts--so we only owed for labor. $350 on a non working car. What I like to call a shiny paperweight. Now here I have to say that we stalled our insurance company, financial, and the shop for quite some time because well everyone wanted money. But we kept in contact with the shop the entire time. Days later I realized there was a chance to make an insurance claim on our car--a last hail Mary to save us and pay everyone if you may. IF the claim would go through the shop would be paid and financial would get much of there money. The day I informed the shop that we were going to have a claims adjuster come out, our car was fully in the shops way and they moved it to another lot. Two days later the shop owner called and said the car had to be moved right away, it was already towed by them, or they would apply for an abandoned title on the car and that would cost us hundreds. I could not get to the shop at that time, and offered to pay half of the bill with my Visa card over the phone. The owner said he could not do it over the phone, and I needed to come in with in the hour. I called our claims adjuster who calmed me down, reminding us that the title was in our name, and it was not abandoned in any way, nor had they had the car 60 days to start the fees. The claims adjuster called the shop and informed them an agent would be out the next day to look at the car.
Insurance would not take the claim and realizing we just needed to give up the vehicle to have it repo and than auctioned I found the full amount the shop was requesting 16 days ago and took my credit card to the shop. The total was supposed to be for labor but there was a $60 towing fee. While I was there paying no other charges or fees were mentioned. And the shop owner said he would call financial to pick up our car that afternoon. I only received the small credit card receipt ---with no details just numbers. But did not contest it, because I thought we were done with them all.
Payment was on a Wednesday on Monday financial told us they were never contacted by the shop and they needed an itemized bill that showed it was released. The shop owner was having surgery and not coming to work and his workers could not tell us anything each time we came to visit. One did say that we had paid the towing fees in full ---and we have that on tape. As well as the ever changing stories from the workers. On each visit they would not give us a detailed receipt, the car keys, our plates off the car, tell us where the car was, or release our car. They did continue to ask us about the car title and hint that we needed proof it was in our name. At this point I was starting to doubt the engine really was the issue with our car, and just wanted a 2nd opinion on the car. But still no car. We called our insurance to file for a stolen car and than the Benson police department. But it became a he said we said thing with both----and they seem to have a different definition of stole than I do.
Finally 12 days after we paid in full we were told the owner would talk to us. And we requested a police stand by. The bill copy he presented was not the same bill I had signed for days before. And had labor listed that the shop had not done. The $60 towing fee was also not on this new bill. So of course the shop said we still owe towing and now storage ---but we owe storage from the Wednesday we paid the full bill on. For only $80 ---- a deal because he is supposed to charge 30$ a day for storage, we could have our car released. And now even after paying that money--they will not tow it anywhere for free. I'm sorry but I am not willing to hand any more money over to Oakley's. Tomorrow marks 16 days that the car has been paid in full. I just need our car back --FIRST to see if the engine really is blown. And than to hand over to the repo man. Two days ago while I was holding my sign on there sidewalk I asked the owner if going viral online was worth the bogus $80? And he replied that it was never about the cash it was about my mouth. Well my mouth did not kick in until the injustices. And so I wish him to get his wish----especially since he is attempting to sell his shop. And I am going to share this all over.
We are also looking for others that have been wronged by this business who might want to join in on lawsuits or at least tell us your story so we can combine efforts. Also send a version of this to local Arizona news---the more people that send this tale, the more they will take notice. Release our car!

Drive It Like You Stole It!
Hello everyone this fine day! I found myself sleeping in till 11 today---and although I must have really needed it, I hate sleeping any where close to that long. Especially in the desert because you wake up to intense heat and because it is already almost to hot to drink refreshing and reviving coffee! That said I am still drinking my coffee with a fan on full blast facing me. ;)I am going in so many directions at the moment to keep afloat that sleeping in that late can be kind of an issue. On the same note it is Sunday- so it's not like many of my things can happen today anyway. Everyone keeps telling me to take baby steps and write all of my tasks down on lists. Over the last few weeks these lists just anger me because I am defiantly adding way more to the lists than completing from the lists. BUT I can already cross off drink coffee for today! And I really am getting things done on all angles. Despite all the people and things holding me back. Number one is my computer--it seems every time I sit down and try to pull of tasks on the computer ---I can not get online. Some day I will have "real" at home Internet service again---some day, but not today because I am beyond poor right now. For reals poor, not the poor I used to tell my wife and everyone else, as I was making $100 in tips a night, so that they would not attempt to borrow cash from me. Another major falling point is how hard even the easiest task seems to be to accomplish. It has always been this way--- try to pay your Internet bill and it turns into an all day task to not get it paid. Because you do not have Internet and they want you to pay the bill over the net even while you are standing in the office.... And when you have 88 similar tasks -well by noon I am usually more than ready to call it a day and find lots of comfort food! even if I roll out of bed around 11. But I have been getting things done-----slowly but surly, and I always read that the turtle wins the race right?
A huge check off the list should happen tomorrow. Should is the key word because it should of happened almost two weeks ago when it was payed in full. But we should be finally getting our dead car out of the shop---so that we can basically turn it over to repo. After involving the insurance company, financing, random strangers that hate this shop, and the police -I believe we are finally getting our fully paid for car out of the shop. Almost two weeks later. Apparently the local police and our insurance company have a different interpretation on a stole car than we do. Although I can not get them to define it for me. Long story short---this car is fully paid for through the shop---even the towing charges, which should not have been--- They will not give us an itemized bill or receipt so that we can turn the car over to repo. The shop will not give us the keys to the vehicle, the plates on it, release the vehicle to us, or tell us where it is. Even though it is payed in FULL. And every day they stall--for almost 2 weeks now, they want to charge storage fees----In my eyes that adds up to a stolin' vehicle but as always what do I know? At any rate just typing this is making me angry again. So more on all of this next blog post.

Our oldest caught the last one---I believe a wolf spider, and it is HUGE---worse yet its been in a sealed jar for daze and is still alive!
Anyways if I run into a snake on the trail----any kind of snake I jump, scream like a lil girl and bolt back to my vehicle. ;)
This bunk bed ladder has been a long running joke for us. It used to be in my wife's travel trailer -and each rung held items---flowers and such.
A friend of ours saw the ladder in the trailers bathroom for the first time and asked what was upstairs....
I will give you minute for this joke to reach you.
Now the ladder is in the friends house and I randomly send her pictures of it
asking what wonders the ladder leads to!
On this day it nice enough to hold my coffee!

First Post O The Month, Tomorrows Will Be Thought Out
Hello! Tomorrow finds me going to a really good country concert with free tickets-- and I really should be sleeping now, because it already is tomorrow. But instead I am going to grace you all with a blog post! Woooo! I have another actual planned and thought out blog post in the works---but that will have to wait for tomorrow. When I say in the works, it means I have been thinking about it --and planning my words and bumping it all around in my head, much like I do when I write an angry letter or try to win an argument with my wife. Try is the key word on that last example. Those of you that are married or in a relationship will fully understand. I win a lot of arguments, and when a boss or otherwise -asks you to leave the room or office, that counts as a win. But I have to say I have never won an argument with my wife. Even if I have before hand won the argument in my head 88 times. Even if I start and end fully in the right. Even if I stop the conversation and we both start to eat lots of food. Even if mid conversation our entire house blows away-----well you catch my drift. With everything turning political -from shoes to football it is hard to enjoy anything. Especially this month the month of 9-11 and marks the anniversary of our marriage a marriage that is almost fully non existent. I love when I explain to bill collectors that I am getting a divorce, how most pause and than tell me they don't know if they should apologize or congratulate me! The phone processors either must all go to the same training school -online, or are all married. In this sad month----today it got a great deal sadder with the death of a legend, Mr Burt Reynolds.
Maybe the flags at all the truck stops should go half mast today?

Just yesterday I needed some air in my lungs after winning an argument, meaning it wasn't with my wife, simply by stumping them with logic. Anyways I really needed to go for a walk and snapped these four pictures.
